What happens during the mediation process of an auto injury claim?

Auto accident. Injuries and filed suit. Depositions. Now an appointment for mediation prior to trial date. What happens during this process?

Both sides agree on a mediator.

Then they meet – starts in the same room. Each side says a little about their case.

Then they are separated. The mediator goes from one room to the other between the two parties. The mediator is trying to point out the weakness in each side’s case and get them to agree on a settlement figure.

Each side pays their own cost and 1/2 of the mediator.

Usually the mediator is another attorney or retired judge. It’s not uncommon for an attorney who has had a long and distinguished career to retire and just act as a mediator.

can i fire my lawyer?

i retained a lawyer for a pedestrian accident in which i was hit by a car but my automobile insurance med pay kicked iin and i didnt know my attorney gets 75.00 out of 1,000.00 can i fire him on my med pay because he hasnt filed suit yet in my accidet
well the reason i want to fire him oon the med pay is i dont feel he should be getting anything because i pay my car insurance each month not my attorney and i ned the money to pay my hospital bills

i had accident once and i fired my first attorney and retained another, i just had to write a letter stating i know longer needed their legal services, you don’t have to tell them why, just make sure you send it certified mail and you will get a copy where the lawyer signed, then you take that letter with you to the next lawyer you hire, he will have to keep it on file showing you are without council because you can’t have 2 lawyers hired for same thing. good luck! and know dn’t do it alone.

Is there a statute of limitations on personal injury claims from an auto accident?

I live in Wisconsin, if that matters.

You have to settle or file suit within three years if you are collecting from the other drivers insurance.

If you are making a claim to your own policy under the Uninsured/Underinsured Motorist Bodily Injury (UMBI) or coverage then under WI statute 893.43 you have six years.

Car Accident.Whats my personal injury claim worth?

I was involed in a car accident on the freeway where i was at a stop in traffic and was hit from behind hard. My BMW was totalled and my medical bills came to $1,700 ( mainly Chiro ) Rental car bill came to $800. Im trying to figure out what is a good settlement. The adjust of the person at fault offered me a rediculous amount of $3,300. Any advice?

personal injury entitles you to your medical fees, pain and suffering (meaning any longstanding problems you continue to have… both psychological and physical), any time and work payments you’ve lost. You’d need a property claim to recover the car fees… but if you’re settling, it’s pretty understood that you’d want the car paid for to… so I’d include the car, towing fees, rental car.

my advice: ask for a lot (because your negotiations are going to pull down your original request), get a lawyer, if the other guy’s not cooperating, you and your lawyer should file a complaint… that’s not hard, it’s not expensive, and it will let the other guy know that you’re serious and not going to settle for anything too low… and if you have to, you can carry on that lawsuit The $3300 is really stupid… even if your car was really old and has over 50,000 miles, it would be worth at least double that… and then you have your injuries and stuff too. Because of the trouble you’ve gone through, I’d say ask for double-triple the price of the car… then if you end up with at least the price of the car, you’d have a decent settlement… I know it wouldn’t pay for everything, but your insurance would cover the rest. Also, you can get the insurance involved in your lawsuit… the insurance really doesn’t want to have to pay anything either, so they’ll be hard on the other guy too… and they’ll probably already have some lawyers.

Motor Vehicle Accident With Injury.. Opinions?

Ok so I have been in accidents before but never resulting in injury. So this old lady pulls out in front of me turning left and I hit her pretty much head on (hitting the drives side of her car) at about 25mph. So I end up finding out that I have potentially tore my rotator cuff, the wreck was no question according to the cop her fault so I have filed my ER visit under her insurance, now that i’ve folled up with my Dr. she has set up an MRI appt. and after that if it is the case I will have surgery then go throw physical therapy…

The damage to my car is almost minimum compared to all this, its being fixed now by her insurances company so what should I do once the car is fixed but i’m still unsure of what is going to happen with my MRI results.

Should I get a lawyer, or stick to keeping in contact with just my insurance company and letting them control talking to the ladies insurance? Any opinions, suggestions greatly appericated!

A lawyer cannot make a claim worth one cent more than it is, so if you hire one he/she will take 1/3 of YOUR settlement as payment.

Only hire one as a last, last, last resort. If the company is cooperating with you now your best move will be to stay on this road. You can always hire a scum-bag lawyer later.
